Comprehensive Summary of Platte County Commissioner Proceedings pursuant W.S. §18-3-516(a) – The Board of County Commissioners, Platte County, Wyoming, met on the 20th day of August 2026 in the county seat of Wheatland. Those present for the meeting were Steve Shockley, Commission Chairman; Ian Jolovich, Commissioner; John “Jeb” Baker, Commissioner; and Malcolm Ervin, County Clerk. Chairman Shockley called the meeting to order at 9:00 AM. Commissioner Jolovich motioned, seconded by Commissioner Baker, to approve the agenda as presented. The motion carried. The motion carried. Inmate Housing Agreement: Commissioner Baker motioned, seconded by Commissioner Jolovich, to approve an inmate housing agreement with the Town of Guernsey. The motion carried. Phase II Renovation: The Board discussed the status of the exterior preservation of the Courthouse. Clerk Ervin informed the Board they needed to prioritize potential additions to the project scope. Planning & Zoning Updates: Planner Bookout informed the Board that the Planning & Zoning Commission started the rule making process at their August 11th meeting. In short, the rule would require that data centers obtain a special use permit prior to construction, which is not currently outlined in the Land Use Rules & Regulations. Public hearings for those proposed regulations will be held on September 16th and October 7th. Public Hearing – Planning & Zoning: Chairman Shockley called a public hearing to order at 10:00 AM for the purpose of accepting public comment on a Special Use Permit request made by Rocky Mountain Tower. The request is to construct a 104’ tall cellphone tower in a Ranching, Agriculture & Mining (RAM) zoning District. The parcel in question is described as part of the NE ¼ SW ¼ of Section 18, Township 24 North, Range 67 West, Platte County, Wyoming. Laura Bookout, County Planner, informed the Board that the request was reviewed by the Governing Body of the Town of Wheatland due to its proximity to municipal boundaries. Planner Bookout also reported that the Planning & Zoning Commission held a public hearing on August 11, 2026 and recommended the request be approved with eight conditions. Chairman Shockley opened the meeting to public comment. Ed Meyer, an adjacent landowner, read a letter that stated he and his wife, Mary, were opposed to the proposed location of the tower. Chloe Butler echoed concerns regarding fertility. Lucinda Houtchens provided an overview of the August 11th Planning & Zoning Commission meeting saying the Commission did not conduct sufficient research regarding health concerns associated with cellphone towers. Steve McGuire, on whose land the tower is proposed to be built, spoke in favor of the request. Shelley Neace said she had been involved in cellphone tower siting for 32 years, and that her husband has been involved in Verizon wireless for more than 30 years. Ms. Neace said in that time, she had been involved with more than 1,000 public comment meetings, and a “not in my backyard” response is typical in each instance. The Board discussed the request. Commissioner Jolovich asked that a condition be added requiring that the applicant work with the Planning Office to obtain a construction certificate because construction costs are expected to exceed $1,000,000. Commissioner Jolovich also asked that condition number eight be amended to remove the word, “only”. Commissioner Jolovich motioned, seconded by Commissioner Baker, to approve a special use permit for Rocky Mountain Tower with nine conditions, and a revision to condition number eight, as discussed. The motion carried. There being no further business for board consideration, the meeting adjourned at approximately 11:45 AM.
