RECORD OF PROCEEDINGS FOR THE GOVERNING BODY OF THE

TOWN OF WHEATLAND

A regular meeting of the Council for the Town of Wheatland, Platte County, and State of Wyoming was held on May 11, 2026, pursuant to the law. Mayor Graves called the meeting to order at 7:00 p.m. The following were present at roll call: Councilman Kaufman, Mixson, Perkins and Evans. Clerk/Treasurer Tabitha Enniss and Attorney Doug Weaver were also present. 

Mayor Graves presented the agenda adding under Executive Session to item H and moving H to I.  Councilman Mixson motioned, seconded by Councilman Perkins, to accept the agenda with noted changes. Motion passed 4-0. Attorney Weaver administered the Oath of Office to Officer Nathan Whipple. Councilman Mixson motioned, seconded by Councilman Perkins, to accept the consent agenda and place it on file. Councilman Mixson made a motion for a $1,000.00 donation, seconded by Councilman Evans.  Motion passed 4-0. Morton Tillman spoke and Jeremy Lang spoke during public comment.  UNFINISHED BUSINESS: Councilman Kaufman motioned, seconded by Councilman Mixson to approve ORDINANCE NO. 858 on third and final reading. Motion passed 4-0.   ORDINANCE NO. 858 AN ORDINANCE ESTABLISHING MONTHLY GARBAGE COLLECTION RATES AND REPEALING ALL OTHER ORDINANCES ESTABLISHING GARBAGE COLLECTION RATES FOR THE TOWN OF WHEATLAND WHEREAS, the Town of Wheatland has built the Wheatland Solid Waste and Transfer Station (WSWTS), and; WHEREAS, the Town of Wheatland governing board realizes costs to run the WSWTS will increase through the transportation of solid waste to the Torrington Landfill, and; WHEREAS, the Town of Wheatland did obtain a loan through the State Land and Investment Board for the construction of the WSWTS which will require repayment; NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WHEATLAND, WYOMING: The following rates are hereby established for the collection of garbage and refuse: Section 1: Residential Rates A. The following dwellings shall be charged a rate of $35.00 per unit per month for weekly collection  a. Single family residential b. Multi-family residential i. Four-plexes ii. Duplexes iii. Apartments iv. Senior Citizen Complexes  v. Mobile Home Parks Section 2: Business Rates A. The following types of business shall pay $45.00 per month for twice a week collection or $65.00 for five day a week collection: 1. Professional offices for each occupied office 2. Community organizations that do not sell food or alcoholic beverages 3. Day care centers not located within a personal residence 4. Churches 5. Platte County Library6. Hardware/Parts stores B. The following types  of business shall pay $190.00 per month for six day a week collection: 1. Restaurants, including not for profit clubs that serve meals on a regular or sporadic basis  2. Convenience stores 3. Large department stores 4. Extended care facilities (not nursing homes) C. The following types of business shall pay $230.00 per month for six day a week collection: 1. Small retail grocery D. The following types of business shall pay $530.00 per month for six day a week collection: 1. Large retail grocery 2. Hospitals 3. Nursing homes 4. Swing bed facilities E. The following types of business shall pay rates as depicted for collection: 1. Hotels/Motels: i. 30 or less rooms, $55.00 per month for twice a week collection.  ii. 31-50 rooms, $80.00 per month for three day a week collection.  iii. More than 51 rooms, $105.00 per month for five day a week collection. 2. RV Parks: i. 15 Spaces or less, $80.00 per month for twice a week collection ii. 16-30 spaces, $155.00 per month for three day a week collection iii. Over 30 Spaces, $230.00 per month for five day a week collection Section 3: Specific Business Rates A. Platte County School District #1 (Libbey, West, WMS, WHS, Administration, Bus Barn, Old Junior High, Maintenance Building) shall pay $755.00 per month for five day a week collection B. Platte County (Detention/Courthouse) shall pay $330.00 per month for five day a week collection. Section 4: Other Rates A. Residential dwellings operating a business shall be billed at the rates defined in Section 2(A) B. In the event of multiple businesses within one property, but operated by different entities, each separate business shall be billed at rates defined in Section 2(A) C. If multiple businesses exist on one property and are operated by the same entity, they will be considered one business. a. Rates will be established by categorizing each business on the property through those definitions listed in the sections above. i. The property will then be billed at the rate defined for the highest categorized business on the property.  b. Weekly collection will be determined in the same manner. D. Any other business not covered in this ordinance shall be subject to the discretion of the Clerk as to the appropriate rate to charge. Section 5: (A)The dumping of solid waste in, on, or near a Town of Wheatland solid waste container by persons who do not pay for solid waste collection through the Town of Wheatland or are not an immediate household member of a person who pays for such services, is prohibited. (B) Incidental use of Town of Wheatland solid waste collection containers in parks, public places, and recreational areas by visitors to the Wheatland community is permissible. (a)Incidental use is defined as garbage or refuse produced through routine daily activities that take place in a public space. Examples of incidental use would include garbage or refuse produced by eating a single meal, consuming a beverage, eating a snack, or disposing of small amounts of paper products.(b)Incidental use does not include household or business waste that is transported to a public space for disposal. Section 6: Repeal All ordinances previously establishing garbage collection rates and refuse are hereby repealed. This ordinance shall become effective on July 1, 2026.Passed and approved this 9th day of March, 2026 on first reading. Passed and approved this 11 day of April, 2026, on second reading. ORDINANCE NO 859 AN ORDINANCE AMENDING WHEATLAND TOWN CODE §8.15.020 (a)(1) ESTABLISHING USE RESTRICTION AND FEES FOR DISPOSAL AT THE WHEATLAND SOLID WASTE TRANSFER STATION(WSWTS)BE IT ORDAINED BY THE TOWN OF WHEATLAND, WYOMING: SECTION 8.15.020 (a) (1) is hereby amended to read as follows: (1)The Wheatland solid waste transfer station (WSWTS) shall be open for use by all residents and businesses of Platte County. (a)Residents and businesses outside the incorporated town limits shall pay 1 ½ times all fee and established rates of Section 8.15.020. Any and all materials accepted for free at the WSWTS will be charged at the Construction Waste & Debris rate for all residents outside the incorporated town limits. This ordinance shall become effective on July 1, 2026.Passed and approved this 9th day of March, 2026 on first reading. Passed and approved this 13th day of April, 2026, on second reading. Councilman Kaufman motioned, seconded by Councilman Mixson to approve, Ordinance 860 on second reading. Motion passed 4-0.  TOWN OF WHEATLAND ORDINANCE NO. 860 AN ORDINANCE AMENDING SECTION 15.05.030 (a) UPDATING THE REFERENCE TO THE ADOPTED INTERNATIONAL BUILDING CODE. Councilman Mixson motioned, seconded by Councilman Kaufman to approve Ordinance 861 on second reading. Motion passed 4-0. ORDINANCE NUMBER #861 AN ORDINANCE AMENDING TITLE 13.40 OF THE CODE OF ORDINANCES OF THE TOWN OF WHEATLAND, WYOMING ENTITLED “BUILDING REGULATIONS” BY CREATING CHAPTER 13.40.150 MODIFYING AND REORGANIZING THOSE PROVISIONS GOVERNING THE IMPLEMENTATION OF A SOLAR ACCESS PERMIT SYSTEM, ESTABLISHING A PROCEDURE FOR PERMITTING AND PROVIDING FOR AN EFFECTIVE DATE.   NEW BUSINESS: Councilman Kaufman motioned, seconded by Councilman Mixson, to approve 2026 Seal Coat & Marking, construction contract agreement. Motion passed 4-0.Councilman Mixson motioned, seconded by Councilman Kaufman, to approve Barr Engineering, engineering proposal. Motion passed 4-0.Councilman Mixson motioned, seconded by Councilman Perkins to go into Public Hearing at 7:30pm. Motion passed 4-0. Councilman Mixson motioned, seconded by Councilman Kaufman to approve the transfer of a Retail Liquor License from Big D Holding LLC (dba Big Dog’s Lanes) to Fast Stop 1131 Inc (dba Wheatland Travel Plaza). Motion passed 4-0. Councilman Kaufman motioned, seconded by Councilman Evans to approve the application for a Bar & Grill Liquor License for Big D Holding LLC (dba Big Dog’s Lanes). Motion passed 4-0. Councilman Mixson motion, seconded by Councilman Perkins to reconvene back to regular council meeting at 7:37pm.  Motion passed 4-0. Councilman Mixson motioned, seconded by Councilman Perkins to adjourn into executive session for discuss of real property acquisition/purchase at 7:38pm. Council adjourned out of executive session at 8:20 pm with no action taken.
