Comprehensive Summary of Platte County Commissioner Proceedings pursuant W.S. §18-3-516(a) – The Board of County Commissioners, Platte County, Wyoming, met in a special session on the 31st day of October 2025 in the county seat of Wheatland. Notice of this special session was provided by the Office of the County Clerk pursuant to Wyoming Statute §16-4-404(b). Those present for the meeting were Steve Shockley, Commission Chairman; Ian Jolovich, Commissioner; John “Jeb” Baker, Commissioner; and Malcolm Ervin, County Clerk. Chairman Shockley called the meeting to order at 3:00 PM for the purposes of considering a Road Use Agreement with NextEra Energy, who are proposing the Chugwater Energy Project. The purpose of the agreement is to ensure that construction use on the road does not degrade road quality. Specifically, the agreement requires that NextEra Energy bond for each mile of gravel road and each mile of pavement road subject to the agreement. That bond would allow the County funds to remediate roads should their quality be diminished and not fixed by NextEra Energy. However, the agreement does require that maintenance, or improvements, of roads are the responsibility of NextEra Energy. A total of 39.5 miles of gravel roads and 15.2 miles of pavement roads were subject to the agreement. Rex Johnson, who was retained by the County to represent them before the Industrial Siting Council, said he was required to submit all pre-filed testimony on November 3rd. Mr. Johnson said the road use agreement will be filed as part of the testimony. Furthermore, Mr. Johnson said there would be a meeting with NextEra Energy prior to construction beginning to finalize the roads in the agreement. Commissioner Jolovich motioned, seconded by Commissioner Baker, to approve, and authorize the chairman to sign, a 2025 Roadway Use Agreement between Platte County and Chugwater Energy Center, LLC and Chugwater Wind LLC. The motion carried. There being no further business for board consideration, the meeting adjourned at approximately 3:30 PM.  The full minutes will be available for inspection online at www.plattecountywyoming.com once they are approved by the Board or in the Office of the County Clerk.
