Comprehensive Summary of Platte County Commissioner Proceedings pursuant W.S. §18-3-516(a) – The Board of County Commissioners, Platte County, Wyoming, met on the 6th day of October 2026 in the county seat of Wheatland. Those present for the meeting were Steve Shockley, Commission Chairman; Ian Jolovich, Commissioner; John “Jeb” Baker, Commissioner; and Malcolm Ervin, County Clerk. Chairman Shockley called the meeting to order at 9:00 AM. Commissioner Jolovich motioned, seconded by Commissioner Baker, to approve the agenda as presented. The motion carried. The motion carried. Commissioner Jolovich motioned, seconded by Commissioner Baker, to approve a Title 25 agreement with Banner Health and authorize the chairman to sign. The motion carried. Commissioner Jolovich motioned, seconded by Commissioner Baker, to approve the Emergency Fire Suppression Account agreement and authorize the chairman to sign. The motion carried. Tax Cancellation: Commissioner Jolovich motioned, seconded by Commissioner Baker, to approve the tax cancellations as presented. The motion carried. Encroachment License: The Board reviewed, and approved, an encroachment license for a new approach on Cassa Road. The license was requested by Jeff Kukowski. Planning & Zoning By-Laws: Commissioner Baker motioned, seconded by Commissioner Jolovich, to adopt by-law changes for the Platte County Planning Commission as presented. The motion carried. Chugwater Energy Project: Planner Bookout presented updates regarding the Chugwater Energy Project. Specifically, Planner Bookout reported that NextEra Energy LLC sough approval to hire Jensen Hughes to comply with Condition #1 of the Battery Energy Storage System (BESS) permit. It was determined Jensen Hughes would be sufficient provided their code reviewer was licensed in Wyoming. Planner Bookout also provided an update with general condition #4 issued on all permits and provided an update on what would be considered “material” findings. In short, that would be any items considered by the Industrial Siting Council. Planner Bookout also spoke about BESS Special Condition #4. The records related to that condition would be uploaded to the County website once received. Site Layer 4 LLC: Blake Marcus, Granite Renewables, requested that negotiations for a community benefit agreement begin soon. Commissioner Baker asked whether a community benefits agreement is designed to mitigate impacts of construction or whether it is something different. Mr. Marcus clarified that the impact of their construction should be mitigated through conditions of their construction certificate. As such, a community benefit agreement is designed to deliver resources to the community. Site Layer 4 held a public meeting on October 5, 2026 to field public concerns regarding data center construction. The Board agreed that additional public meetings, hosted by Site Layer 4, would be beneficial in developing a community needs list. There being no further business for board consideration, the meeting adjourned at approximately 10:30 AM.
